These Terms of Service (hereinafter “TOS”) are intended to define the terms and conditions for using the DocSimulator™ application (hereinafter “the Application” or “the Product”).
By accessing the Application, the educational institution, community, and/or training center (hereinafter the “Client(s)”) obtains access to the Digital Content for the duration and/or for a specified number of students (hereinafter “the User”) by entering into an agreement with compuute.io (hereinafter “the Developers” or “the Publisher”). Any use of the Application constitutes full and unconditional acceptance of these TOS.
The hosting is provided by the company compuute.io (details above) or by a third-party provider if necessary.

The DocSimulator™ Application is a medical training platform based on simulated clinical cases. It notably offers:

The Application is accessible via a username and password, the confidentiality of which is the sole responsibility of the User. Any use of these credentials is presumed to be by the User. In the event that a third party uses these credentials, the User may be held liable.
In exchange for payment by the Client for one or the other of the Products, or as part of a promotional offer, the Publisher grants the Client a license/subscription—that is, a non-exclusive, non-transferable right to use the Application under the conditions defined in the contractual documents and these TOS. This license is assigned by the Client to a User for a specified period and within the limits of the contractual duration and the number of downloads (the latter being specified in the Product sheet).
The contractual documents accepted by the Client set forth the commercial terms of the products (price, duration of the license/subscription, etc.). Regardless of the duration stated in the contractual documents, the Publisher will not provide any full or partial refund for the purchased Products, either during or at the end of the contract.
The right to use the Products is granted, effective as of the date of purchase of the license/subscription, for one or more academic or training years. For licenses acquired for a period exceeding one year, and if the purchase occurs between April and June of the current year, the right to use the Product is granted for the remainder of the current academic or training year and for the subsequent academic or training year(s).
Before acquiring the right to use the Product, the Client must verify that it possesses the required configurations and/or software to access the Digital Content. These configurations are listed at the end of this chapter.
Where possible, the Publisher may update the Products to adapt them to new configurations available on the market; in such cases, the Client shall benefit from these updates for the duration of the right to use. The Publisher reserves the right to modify the functionality and appearance of its Products and Digital Content. In any event, it is the responsibility of the Client to upgrade the technical specifications of its equipment so that the Product can continue to be used under proper conditions until the end of the contractual relationship, without any recourse against the Publisher.

It is the responsibility of the Client and the Users to take all necessary measures—without recourse against the Publisher—to ensure that their equipment meets the technical requirements, including the minimum configuration indicated above. All software updates required to access the Product, including operating system updates, are the sole responsibility of the Client and/or the Users.
In exchange for payment by the Client for one or the other of the Products, or as part of a promotional offer or test pilot program, the Publisher grants a non-exclusive, non-transferable license to use the Application subject to the conditions defined in these TOS. This license is assigned by the Client to a User for a specified period and within the limits of the access rights specified in the contractual documents or specific to the pilot program. The Publisher reserves the right to suspend or revoke access to the Application at any time in the event of non-compliance with these TOS or for any other legitimate reason.
In the context of a test or pilot program:
The service is fee-based, although a free trial may be offered to the Client or User under the terms specified at registration or in specific contracts. The User remains solely responsible for any fees related to Internet connectivity and the necessary technical equipment.
For reasons of maintenance, updates, or any other legitimate cause (including force majeure), access to the Application may be suspended or limited at any time without notice or compensation.
The Publisher reserves the right to modify the Application at any time and without notice, both from a technical and functional standpoint, in order to improve its quality or to comply with legal obligations.
During registration and use of the Application, personal data may be collected, such as the user’s name, first name, email address, educational performance, etc.

By accepting these TOS, the User authorizes the Publisher to reuse their data in a strictly anonymized manner for research and scientific publication purposes, including as part of a test or pilot program. In the context of these programs, the data are processed in an anonymized or pseudonymized manner in accordance with legal requirements. No processing unrelated to the educational or research objective will be carried out without explicit consent.
In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, the User has, in particular:

The User’s personal data shall be retained only for as long as necessary to achieve the purpose of the processing and in compliance with the retention periods required by applicable law.
The Application as a whole, as well as each of its components (including but not limited to texts, scenarios, algorithms, trademarks, logos, images, videos, graphic design, software, databases, etc.), is the exclusive property of the Publisher and/or its partners and is protected by national and international intellectual property laws.
The Publisher grants the User, for the duration of this agreement, a personal, non-exclusive, non-transferable license to access and use the Application. This license does not confer any proprietary rights in any of the aforementioned elements.
Any reproduction, copying, representation, adaptation, publication, distribution, transmission, modification, extraction, resale, or exploitation—whether partial or complete—of the Application and/or any of its elements, for commercial or non-commercial purposes, is strictly prohibited without the prior written consent of the Publisher. Any violation of this prohibition may result in civil and/or criminal proceedings in accordance with applicable law.
Any feedback, suggestion, or improvement submitted by the User or the Client to the Publisher in connection with the use or testing of the Application may be used freely by the Publisher to improve the Application, its functionalities, or its performance, without any financial or other compensation to the User or the Client.
The User agrees to indemnify and hold harmless the Publisher from any claims, lawsuits, damages, or liabilities—including attorney’s fees—resulting from the User’s failure to comply with their legal, contractual, or regulatory obligations.
The Publisher shall not be liable for any direct or indirect damages resulting from the use of the Application in a test or pilot program, including but not limited to data loss, service interruptions, or incompatibilities with the User’s technical equipment.
The Application uses cookies or similar technologies to improve the User’s experience and to analyze platform usage.
These TOS take effect upon the User’s registration on the Application and remain in force as long as the User is registered or uses the Application. The User may terminate their account at any time by submitting a request via their personal account or by email.
In the event of participation in a test or pilot program, the Publisher reserves the right to terminate access to the Application at any time without notice at the end of the defined test period. Such automatic termination includes the deletion or deactivation of the credentials associated with the User or the Client.
In the event of any violation of these TOS, the Publisher may immediately suspend or terminate access to the Application without compensation or notice.
These TOS are governed by French law. In the event of any dispute—and following an attempt at amicable resolution—only the courts of Montpellier shall have jurisdiction.
In the event of any dispute or disagreement related to the use of the Application, the parties agree to attempt to resolve the conflict amicably before resorting to the competent courts.
If one or more provisions of these TOS are deemed invalid, illegal, or unenforceable by a competent jurisdiction, the remaining provisions shall remain in full force and effect.
The Publisher reserves the right to modify or update these TOS at any time. The User will be informed of any changes by appropriate means (e.g., notification within the Application, email, etc.). By continuing to use the Application after the revised TOS are published, the User accepts the modifications.
